IDENTIFICATION OF THE RESPONSIBLE PARTY
CM SERVICIOS ESPECIALIZADOS DE IDIOMAS, S.C., hereinafter referred to as "CM IDIOMAS," with address for the purposes of this privacy notice at Av. San Jeronimo 162, Colonia la Otra Banda, Alcaldía Alvaro Obregón C.P. 01090, in Mexico City, holds the status of responsible party in relation to customers or prospects (hereinafter "THE HOLDER") regarding the processing of their personal data or that of third parties provided in accordance with the provisions set forth below, in accordance with the aforementioned current and applicable legislation.
PURPOSE OF THE PROCESSING OF PERSONAL DATA
"CM IDIOMAS" informs you that the information of "THE HOLDER" is treated strictly confidentially. Therefore, by providing your personal data, they will be used exclusively for:
Verifying the identity of "THE HOLDER," the accuracy of the information and documents provided as their own, as well as those of their representatives, beneficiaries, references, joint obligors, guarantors, as applicable according to the contracted service and in compliance with current provisions regarding customer knowledge and prevention of money laundering.
Formalizing a contractual relationship between "THE HOLDER" and "CM IDIOMAS" and providing the contracted services as agreed upon between the parties, as well as, if applicable, requiring compliance with them. Conducting an analysis of the information provided by "THE HOLDER" in order to determine, in accordance with current legal provisions, the level of risk, payment feasibility, transactional profile, and, in general, carrying out any other evaluation required by regulations or deemed convenient for the provision of the services offered and requested, in accordance with the procedures and administrative policies of "CM IDIOMAS".
Sending satisfaction surveys to "THE HOLDER" regarding the services provided, generating statistical information related to the use of the service, conducting internal studies on consumption habits, offering benefits, promotions, or discounts to "THE HOLDER," informing about changes to the products or services of "CM IDIOMAS," fulfilling tax obligations, issuing invoices, or others related. Complying with requests from various authorities. Conducting marketing activities, advertising, and market behavior analysis. Carrying out complementary activities necessary for the achievement of the aforementioned purposes. The personal data provided by "THE HOLDER" may be transferred, with prior authorization, within the country, for strictly necessary purposes for the provision of the services offered and/or contracted. "THE HOLDER" hereby states, under oath of truthfulness, that the information provided to "CM IDIOMAS" is true. Therefore, in case of the contrary, it will be rejected, obligating them to indemnify "CM IDIOMAS" from any controversy, litigation, proceeding, or claim of any legal nature arising from the foregoing, causing any inconvenience, harm, damage, or detriment, as well as, if applicable, the imposition of fines or sanctions of any legal kind.
Additionally, we use your information to market our products. Although it is not necessary to provide the services and products you request or contract with us, it allows us to provide you with better service and enhance its quality.
MECHANISMS FOR THE HOLDER TO EXPRESS THEIR REFUSAL FOR THE PROCESSING OF PERSONAL DATA
"THE HOLDER" who does not wish their personal data to be processed for the secondary or accessory purposes described in this privacy notice must submit a written request or use the ARCO Request Form, either in person at our aforementioned address or by sending the respective document to the email address datospersonales@cmidiomas.com. The request should specify: full name and address or other means to communicate the response to their ARCO rights request; attach the documents proving their identity or, if applicable, the legal representation of the client or prospect (official identification), and a clear and precise description of the personal data concerning which they seek to exercise any of the ARCO rights, in addition to any other document facilitating the location of personal data, in terms of Article 29 of the Federal Law on the Protection of Personal Data Held by Private Parties. Refusal to use personal data for secondary purposes will not be grounds for denying the services and products requested or contracted with us. However, "THE HOLDER" must consider and bear in mind that, for certain purposes, revocation of consent to the processing of information may imply that "CM LANGUAGES" cannot continue to provide the product and/or service requested by "THE HOLDER," on the terms and scope offered, as well as contracted, and therefore releases it from any legal liability for non-compliance in this regard.
PERSONAL DATA COLLECTED
To carry out the purposes described in this privacy notice, we will use: i) Identification data, ii) Contact data, iii) Employment data, iv) Academic or professional data, v) Migratory data, vi) Financial and/or patrimonial data, and vii) Health data. These will be treated with the corresponding sensitivity and care.
Furthermore, the data of third parties that, if provided, will be understood to have the consent of the corresponding Data Subject, under their strict legal responsibility and releasing "CM IDIOMAS" from any liability.
TRANSFER OF PERSONAL DATA
"THE HOLDER" authorizes "CM IDIOMAS" to transfer their data to affiliated or subsidiary companies identified or associated with it, as well as to authorized distributors and/or service providers with whom it has a legal relationship, as well as national or foreign third parties. The third parties and recipients of personal data have the same obligations and responsibilities as "CM IDIOMAS" to protect their personal data in accordance with the provisions of this privacy notice. If "THE HOLDER" does not express their opposition as per the terms herein, it will be understood that they have given their consent for their personal data to be transferred.
PROCEDURE TO EXERCISE ARCO RIGHTS
“CM IDIOMAS”, has adopted levels of security and protection of personal data in accordance with applicable legislation in the country. Therefore, we inform you that you have at all times the power to exercise your Rights for the protection of the processing of your personal data, consisting of: access, rectification, cancellation, and opposition (ARCO), in accordance with the following procedure:
1.- The client or prospect must personally deliver the "ARCO Request Form" at the address located at Av. San Jerónimo 162, Colonia la Otra Banda, Alcaldía Álvaro Obregón C.P. 01090, in Mexico City, or send it to the email datospersonales@cmidiomas.com.
2.- The "ARCO Request Form" must legibly indicate the full name and address or other means to communicate the response to their ARCO rights request.
3.- Documents proving their identity or, if applicable, the legal representation of the client or prospect (official identification) must be attached.
4.- Clearly and precisely indicate the personal data concerning which they seek to exercise any of the ARCO rights.
5.- Attach the documents facilitating the location of personal data, in terms of Article 29 of the Law.
The response to your request for ARCO Rights will be sent to you within a period of 20 business days counted from the receipt of said request; on the other hand, it is informed that the right of access will be deemed fulfilled when the corresponding response is sent through the provided email. The deadline may be extended only once for an equal period, provided that the circumstances of the case justify it. It is important to consider that by requesting the cancellation of your personal data, a period of blocking and deletion of your data will be generated; however, in terms of Article 25 of the applicable Law, 'CM IDIOMAS' may retain them only to fulfill obligations arising from the processing of the same.
USE OF COOKIES
"CM IDIOMAS" may directly or indirectly use Cookies and Web Beacons or other similar technology, for which reason it is informed to the Holders that, at all times, they can disable the use of these mechanisms, according to the instructions that each owner of browsers (internet browser or viewer) has implemented to activate and deactivate said Cookies. Users can change their options through their computer equipment and/or browsers to stop accepting Cookies, Web Beacons, or other similar technologies, or to confirm whether they accept them or not.
MODIFICATION TO THE PRIVACY NOTICE
This privacy notice may undergo modifications, changes, or updates derived from new legal requirements; from our own needs for the products or services we offer, changes in our business model, or for other reasons, such modifications will be informed through physical notice in our branch, through the internet, or by any other printed or electronic means. Once the Privacy Notice is published on the Site, it will automatically enter into force.
